Terms & Conditions
In this modern world, companies have to protect
themselves and, at the same time, protect their customers as
well. We take great pride in our company and it shows in the
quality of work we do. We also do everything we can to protect
you, our customer. We apply only approved certified procedures
for processing. Even after applying all the technology known to
the industry and years of experience, hazards still remain in
the processing results. In order to avoid misunderstandings,
we have set forth the following terms and conditions. We think
you'll agree that these terms and conditions meet this challenge
and protect both of us.
Responsibilities
- Customer
Your order must contain a purchase order, printed
blueprint and detailed instructions with your
specifications required. We will assume no liability after complying
with those instructions.
- Processing Acceptance
We assume all parts to be accepted if we are not notified within 10
working days following receipt. Rejected parts must be returned to us
for inspection and or rework. Further processing or assembly of
rejected parts, materials, etc. by you or any other party will
remove any liability on our part. If, upon our inspection, a part
is determined to be improperly processed by us, charges for that
part will be waived.
- Customer Shipping
We are not liable for any loss or damage to material while
in transit to our facility, whether in vehicles owned by the
customer or any third party acting on our or the customer's
behalf. If you supply shipping containers, every effort will be
made to use the same container for shipment of the processed
order back to you. We cannot be held liable for damage caused by
using a customer supplied container. If you require other packaging,
a written statement will be required. We will charge for materials
and labor for specialized packaging.
- Our Liabilities
Our liability is limited to the cost of direct
labor and material of the product directly damaged by our
processing, or two times our processing charges on such
product, whichever is the lesser. Charges for our services are
based on these limitations of our liability. This includes, but
is not limited to, scrap and loss for any reason that results in
shipped quantity discrepancies. Liability greater than outlined
above will be assumed by us only when agreed to in writing prior
to processing, and may result in an increased charge for our
services. Under no circumstances will we be considered as an
insurer of customer materials, and shall not be liable,
regardless of cause, for loss by explosion, fire, theft,
vandalism, or acts of nature while such material is in our
possession.
- Processing Cancellation
If an order is cancelled while being processed you will reimburse us for
any work performed and other expenses related to the processing of
the cancelled order.
- Late Charges
Unpaid invoices beyond normal terms (Net 30) will be charged a monthly
finance charge of two percent (2%) each month the invoice remains unpaid.
- Part Shortages
If upon the return of an order, a shortage is noted,
a claim must be presented to us in writing
within ten (10) working days. Shrinkage of
quantity in processing of five percent (5%) will be
allowed without charge or liability.
- Responsibility of Others
We assume no responsibility for defective plating,
anodizing or other finishes on materials supplied to us
that have been previously finished by others. We
reserve the right to reject parts or charge extra if the
part requires additional work beyond the customer
supplied instructions.
- Special / Experimental Processing
Any process that exceeds or deviates from a specified
specification will be considered experimental. Our
charges for such processing are not contingent upon the
success of the work performed.
- Quotations
Quotations are valid for 60 days from issuance. All quotations must be
in writing, Oral quotations will not be honored.
- Expedite Policy
Parts will not be expedited if it is not clearly stated
"EXPEDITE"
on the purchase order.
- Touchup Paint Kits
Certified Paints are very expensive, ranging from
$200.00 to $800.00 per gallon kit. Paint purchases for our
operation account for approximately 7 % ($434,000.00 for 2008)
of our operating cost per year. OMT realizes you will need
touchup kits during assembly. The cost of these paints and the
time to prepare a touchup kit are sometimes more than our profit
from the job itself. To be fair for all our customers, OMT will
charge $25.00 for a 4 oz. kit and $75.00 for a 32 oz. kit and an
additional $10.00 charge will apply if certification is
required. This will pay for the product and labor involved.
These prices may change with increases from our suppliers.
